Terms of Service

Last updated: 18 August 2026

These Terms of Service ("Terms") govern your access to and use of BrewVoice and any related websites, applications and services provided by BrewApps ("BrewApps", "we", "us", "our"). By creating an account, using the service, or opting in to receive messages from us, you agree to these Terms. If you do not agree, do not use the service.

1. Who these Terms apply to

These Terms apply to two groups:

Customers. Businesses and individuals who register for a BrewApps account and use BrewVoice to place, answer or follow up on calls with their own contacts.

Recipients. People who receive a call or message placed through BrewVoice, or who opt in to receive text messages from us or from a Customer. Sections 9 and 10 apply to you.

Where a Customer uses BrewVoice to contact you, that Customer decides why you are being contacted and is responsible for the content of the communication. Our role and our respective responsibilities for personal information are described in our Privacy Policy at /privacy.

2. The service

BrewVoice is an AI voice agent. It answers inbound calls, places outbound follow-up calls, sends related text messages, transcribes and summarises conversations, books appointments, and writes results back to the systems a Customer has connected.

Calls are handled by an automated agent, not a human. Where required by law, BrewVoice can be configured to disclose at the start of a call that the recipient is speaking to an AI agent, and it is the Customer's responsibility to enable that disclosure where it applies.

We may add, change or remove features at any time. We will give Customers reasonable notice before removing a feature they materially rely on.

3. Accounts and eligibility

You must be at least 18 years old and able to enter a binding contract to register an account. You are responsible for the accuracy of your registration details, for keeping your credentials secure, and for all activity that occurs under your account. Tell us promptly at contact@thebrewapps.com if you believe your account has been accessed without authorisation.

You may not share your account with anyone outside your organisation, or resell access to the service, without our written agreement.

4. Customer responsibilities for consent and calling practice

This section is the core of your obligations as a Customer. You are solely responsible for ensuring that every contact you upload, sync or dial is one you are legally permitted to contact.

You represent and warrant that:

You may not use BrewVoice to send unlawful, deceptive, harassing, defamatory or fraudulent content, to impersonate another person or business, to send content relating to cannabis, illegal substances, firearms, high-risk financial offers, or any other category prohibited by our telephony providers or by the mobile carriers, or to attempt to disguise the automated nature of the agent where disclosure is required.

We may suspend an account immediately, without notice, where we reasonably believe these obligations have been breached, where a carrier or telephony provider requires it, or where continued operation would expose us or a third party to legal risk.

5. Third-party integrations

BrewVoice connects to platforms such as Meta Lead Ads, Google Sheets, HubSpot, Salesforce, Zoho, Pipedrive, Freshsales and calendar providers. Your use of those platforms is governed by your agreement with them, not by these Terms. You are responsible for holding the necessary rights and permissions on each connected account, and for the accuracy of data that flows in from them.

We are not liable for a third-party platform changing its API, restricting access, or going offline. You can disconnect any integration at any time from your BrewVoice settings.

6. Fees

Where your plan is paid, fees, billing cycle and usage allowances are set out at the point of purchase. Fees are payable in advance and are non-refundable except where required by law. Usage above your allowance, including call minutes and message volume, is billed at the rates published for your plan. We may change pricing with at least 30 days' notice before the change takes effect for you.

Unpaid amounts may result in suspension after we have given you notice and a reasonable chance to pay.

7. Your data and our data

You retain all rights in the contact records, call recordings, transcripts and other content you supply to or generate through the service ("Customer Data"). You grant us a licence to host, process and transmit Customer Data only to operate and support the service for you, as described in our Privacy Policy.

We do not sell personal information, and we do not use the contents of calls, messages or contact records to train our own or any third party's general-purpose AI models.

We retain all rights in BrewVoice itself, including the software, models, prompts, interfaces, documentation and branding. You may not copy, reverse engineer, scrape, or build a competing service from it, and you may not use our name or logo without permission.

We may use aggregated and de-identified usage statistics, which do not identify you or any individual, to operate and improve the service.

8. AI-generated output

BrewVoice generates speech, summaries and appointment details automatically. Output can be inaccurate, incomplete, or misinterpret what was said on a call. Transcripts are not certified records.

You should not rely on BrewVoice output as the sole basis for a decision that has legal, financial, medical or safety consequences. Review call summaries and appointment details before acting on them. You are responsible for what the agent says on your behalf, including where it produces an inaccurate statement about your business, your pricing or your availability.

9. SMS and text messaging terms

By opting in to receive text messages from BrewApps, you agree to the following terms.

Consent. You consent to receive recurring SMS/MMS messages from BrewApps, including but not limited to account notifications, service updates, and customer support communications.

Frequency. Message frequency varies.

Cost. Message and data rates may apply. These are charged by your mobile carrier, not by us.

Opting out. You may opt out at any time by replying STOP to any message. After opting out, you will receive a confirmation message and no further messages will be sent.

Help. For assistance, reply HELP or contact us at contact@thebrewapps.com.

Your mobile information. Your mobile phone number and opt-in data will not be shared with or sold to third parties. See our Privacy Policy at /privacy for full details.

Carriers. Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and depends on your carrier, device and network coverage.

Eligibility. You must be the account holder of, or have permission to use, the mobile number you enrol. You must be at least 18 years old to opt in.

Consent to receive marketing text messages is not a condition of purchasing any goods or services.

10. Recipients of calls and messages

If you receive a call or message placed through BrewVoice by one of our Customers, you can ask to stop being contacted at any time. Tell the agent during the call, reply STOP to any text message, or email contact@thebrewapps.com. We record the request against your number so that it is honoured on future campaigns.

Because we usually act on a Customer's behalf, we may need to forward a request about your information to that Customer and let them respond. We will tell you when we do.

11. Service availability

We aim to keep BrewVoice available, but we do not guarantee uninterrupted service. Calls depend on telephony carriers, speech and AI model providers, and internet connectivity that we do not control. We may take the service down for maintenance, and will try to schedule this outside peak calling hours.

12. Suspension and termination

You may close your account at any time from your settings or by writing to contact@thebrewapps.com. We may suspend or terminate your account for breach of these Terms, for non-payment, or where required by a provider, regulator or law.

On termination, your right to use the service ends immediately. We will delete or anonymise Customer Data within a reasonable period as described in our Privacy Policy, except where we must keep it to meet a legal obligation or resolve a dispute. Records of do-not-contact requests are kept for longer, because deleting them is what would allow contact to resume. Export your data before closing your account.

13. Disclaimers

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be error-free, secure, uninterrupted, or that AI output will be accurate.

We do not provide legal advice. Nothing in the service or its configuration options constitutes advice on whether a particular call or message is lawful in your jurisdiction.

14. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data or business interruption, even if advised of the possibility.

Our total aggregate liability arising out of or relating to these Terms or the service is limited to the amounts you paid us for the service in the twelve months before the event giving rise to the claim, or USD 100 if you have paid us nothing.

Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.

15. Indemnity

You will indemnify and hold harmless BrewApps and its officers, employees and providers against any claim, penalty, fine, loss or cost, including reasonable legal fees, arising from your use of the service, from the content of calls or messages you send, from your breach of Section 4, or from a claim that a contact did not consent to be contacted by you.

16. Changes to these Terms

We may update these Terms as the service changes. The date at the top shows when they were last revised. We will notify account holders of material changes before they take effect. Continuing to use the service after that date means you accept the revised Terms.

17. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules. The courts of the State of Delaware have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

Before filing a claim, each party agrees to contact the other and attempt in good faith to resolve the dispute informally for at least 30 days.

18. General

These Terms, together with the Privacy Policy and any order form, are the entire agreement between us on this subject. If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
